Terms of Service.

The short version, in plain language

Outkidding is a simple subscription that mails tips and activity ideas for parents to interpret and run with their kids each week. We don't supervise anyone in person. Being out in the world — trees, dirt, sidewalks, bugs, weather, other humans — carries obvious, inherent risk. By signing your kid up for Missions you agree to supervise them continuously, use your own judgment about what's age-appropriate and safe, and accept the risk of injury, harm, loss, boo-boos, accidents, bug bites, or any harm to person or property that may come from doing a Mission. You waive all claims, financial or otherwise, against Outkidding for any such harm.

1. About Outkidding

Outkidding ("Outkidding," "we," "us," or "our") is a simple subscription business that mails weekly newsletters. Each letter contains one Mission — a Mission Overview addressed to the child, plus a Mission Dossier covering Mission Prep, the Mission itself, and Mission Notes for afterward — intended to be reviewed, interpreted, and supervised by a parent or legal guardian and carried out together with the child at the guardian's sole discretion. The Missions are informational and educational only. Outkidding does not provide professional instruction, coaching, childcare, safety oversight, medical advice, or any form of in-person supervision.

By subscribing to, accessing, or using the Outkidding newsletter, website, or any related materials (collectively, the "Service"), you agree to these Terms of Service (the "Terms"). If you do not agree, do not use the Service.

2. Eligibility & guardian acknowledgement

You must be at least 18 years of age and the parent or legal guardian of any child who participates in a Mission. By using the Service you represent that you are acting in that capacity and have full legal authority to accept these Terms on behalf of yourself and any minor in your care who participates in a Mission.

3. Subscription, billing & cancellation

Subscriptions are billed in advance on a recurring basis at the price disclosed at checkout. You may cancel at any time from your account; cancellation will stop future renewals but will not retroactively refund the current billing period unless required by law. We may modify pricing, contents, shipping cadence, or features of the Service with reasonable notice.

4. Assumption of risk

Please read this section carefully. The Missions encourage children and their guardians to go outside, interact with nature, move through their communities, use everyday tools and materials, and engage with other people. These activities — like all of life — involve inherent and obvious risks, including but not limited to: cuts, scrapes, bruises, falls, sprains, fractures, bites and stings from insects or animals, allergic reactions, exposure to plants, weather, water, sun, or terrain, illness, property damage, and, in rare cases, serious injury or death.

By participating in any Mission, you knowingly and voluntarily assume all such risks on behalf of yourself and any minor in your care, whether those risks are foreseen or unforeseen, and whether arising from the Mission itself, the environment, the conduct of third parties, or the ordinary realities of being out in the world.

The Missions are designed in good faith to be reasonable activities for children undertaken with the continuous and active in-person supervision of a parent or legal guardian. You agree to evaluate each Mission against your child's age, ability, and temperament, and against your local conditions, weather, and surroundings, and to modify, postpone, or skip any Mission that you determine in your sole judgment is unsafe or inappropriate.

5. Release & waiver of liability

To the fullest extent permitted by applicable law, you hereby release, waive, discharge, and covenant not to sue Outkidding, its owners, officers, employees, contractors, contributors, and affiliates (collectively, the "Released Parties") from any and all claims, liabilities, demands, actions, causes of action, costs, and expenses of any kind — including without limitation those for personal injury, illness, emotional distress, property damage, lost wages, or wrongful death — that arise out of or relate in any way to (a) any Mission or any attempt to follow, adapt, or interpret Mission materials; (b) any decision you make as a guardian in connection with the Service; or (c) your or your child's presence in any location, interaction with any person, animal, plant, object, or condition encountered in connection with a Mission, whether the harm is caused in whole or in part by the negligence of any of the Released Parties or otherwise.

You further agree to indemnify, defend, and hold harmless the Released Parties from any third-party claim arising out of your or your child's participation in any Mission or your use of the Service.

6. No professional advice

Mission content is not medical, psychological, educational, legal, or safety advice. Outkidding does not certify any activity as safe for any particular child. You are solely responsible for verifying age-appropriateness, local laws and regulations (including those concerning trespass, foraging, wildlife, and fire), property permissions, and current site conditions before beginning any Mission.

7. Mission feasibility & your environment

We make no warranty or guarantee that all Missions are doable in any weather or any environment. In fact, it will often be true that inclement weather or certain locations — for example, if you live on top of a mountain, under the sea, on the moon, or in the densest urban depths — will impact your ability to do a Mission exactly as described.

Missions are written with everyday kids in the United States and everyday living conditions in mind: a community, some access to nature, some access to urban or suburban settings, access to transportation, and access to common household goods. They are also highly adaptable should a family, a child, or just a weekend itself introduce new constraints. Treat them as creative inspiration, not as explicit hard promises of adventure.

We make no claim that you will always, on a Saturday or otherwise, be able to complete any one Mission. If the Missions turn out to be not doable for you and your child, it is your responsibility to unsubscribe and end payment promptly. We do not offer refunds typically, as our business is very lean and our value — the Mission letter, primarily — is sent weekly.

8. Disclaimer of warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted service. We do not warrant that Missions will achieve any particular educational, developmental, or experiential outcome.

9. Limitation of liability

To the maximum extent permitted by law, in no event will the Released Parties be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, goodwill, data, or other intangible losses, arising out of or in connection with the Service. The Released Parties' total cumulative liability for any claim arising out of or relating to the Service will not exceed the amount you paid to Outkidding in the twelve (12) months immediately preceding the event giving rise to the claim.

10. Intellectual property & user submissions

All Mission content, artwork, copy, and design is owned by Outkidding and is licensed to you for personal, non-commercial use within your household. If you send us photos, drawings, notes, or other submissions, you grant Outkidding a worldwide, royalty-free, non-exclusive license to use, reproduce, and display them in future letters and marketing materials, with reasonable efforts to omit identifying information about minors on request.

11. Changes, governing law & contact

We may update these Terms from time to time; continued use of the Service after an update constitutes acceptance. These Terms are governed by the laws of the State in which Outkidding is organized, without regard to conflict-of-laws principles. Any dispute will be brought exclusively in the state or federal courts located there.
